    ISIS views spread in Balkans as Kosovo police nab 40 militants

    Over 40 people have been arrested in Kosovo on strong suspicion of maintaining close links with the Islamic State in Syria and Iraq. Authorities in the small Balkan nation said the Monday arrests were part of “a major police operation” aimed at preventing Kosovar citizens from joining the violent Islamist group. Kosovo gained independence from Serbia in 2008, following several revolts and uprisings in the 1990s. The vast majority of its citizens are ethnic Albanians, most of whom practice Islam. However the lifestyle of its largely pro-American population remains markedly secular. Observers have thus been startled by reports that an estimated 100 to 200 Kosovars have so far traveled to Syria and Iraq to join the Islamic State, known previously as the State of Iraq and al-Sham, or ISIS. Last week, an 18-year-old Islamic State volunteer from Kosovo was reported killed in Syria; he was the 16th Kosovar member of the Islamist group to have been killed in the field of battle. There is allegedly footage on YouTube showing Lavdrim Muhaxheri, the commander of the Kosovar Islamic State members decapitating an Iraqi teenager. Aside from the detention of 40 suspects, the Monday crackdown is believed to have netted significant numbers of weapons and ammunition discovered in more than 60 locations around the country. Police said that the dates of birth of the arrestees range from 1962 to 1994. Authorities are looking for more suspects who were “not found at their homes” during the countrywide crackdown, while many Muslim clerics are also being investigated for links to radical Islamist groups. The 40 that are in custody are now being questioned under procedures recently established by the Kosovo Penal Code, designed to protect “constitutional order and security in the Republic” of Kosovo. Reports from the tiny Balkan nation suggest that its parliament is preparing to pass national legislation forbidding citizens form joining foreign armed movements. A prison sentence of up to 15 years is being considered for those who do so. It is worth noting that Albanian is among the primary languages into which the Islamic State’s Arabic-language proclamations are usually translated by the militants —the others being Russian, Turkish, English and French.

    In a surprise announcement, France said Wednesday morning it will send arms "in the coming hours" to Kurdish forces in Iraq to aid in their fight against ISIS (AP). The announcement comes a day after the European Union failed to establish a common policy on the issue, agreeing only that individual states could—in agreement with Baghdad—send weapons to Kurdish forces (NYT). Meanwhile, the Obama administration deployed another 130 military advisers (FT) to the Kurdish capital of Erbil on Tuesday in what the Pentagon described as a "temporary mission" to assess the humanitarian crisis and help trapped Yazidi civilians on Sinjar mountain.
    Analysis
    "There is still an opportunity to draw back from the brink. Iraq is now in the process of replacing its prime minister. What Iraq sorely needs is a transformational leader of Faisal's caliber—one that can navigate the potentially devastating storms that are gathering and shift Iraqis away from the mind-set that views the redressing of wrongs as vengeance and equates the loss of absolute power with complete powerlessness," writes Ali Allawi for theNew York Times.
    "In other words, Obama's moves do not amount to a resumption of the Iraq war but rather a necessary response, not only to a humanitarian crisis but to a mortal danger facing a vital ally," writes Fred Kaplan for Slate.
    "The US should carry out sustained attacks on Isis in both Iraq and Syria. The border is irrelevant; what is essential is that Isis is slowed and weakened. Economic and especially military aid to the Kurds holding the line against Isis should be increased and sped up," writes CFR President Richard N. Haass for the Financial Times.

    Japan Suffers Economic Contraction

    MYANMAR: Myanmar is in preliminary talks to net its first credit rating, the Wall Street Journal reported (WSJ). The rating would allow an eventual debut global-bond sale by a country still recovering from decades of military rule.
     
    MIDDLE EAST
    Israel-Hamas Talks Continue
    Egypt presented a cease-fire proposal to Israeli and Palestinian parties early Wednesday after negotiators gathered for a second day of talks aimed at resolving the month-long crisis (Haaretz). Negotiators in Cairo are addressing the issue of the Israeli Gaza blockade(al-Jazeera) as the clock runs down.
     
    AFRICA
    UN Threatens South Sudan With Sanctions
    United Nation Security Council envoys warned South Sudan's warring leaders of sanctions if the civil war, which has pushed the young nation to the brink of famine, perpetuates (al-Jazeera). Representatives of the council, which was in the capital of Juba for a two-day mission, are also due to meet rebel chief Riek Machar.
    MOZAMBIQUE: Mozambique's parliament approved an amnesty law that will allow opposition leader Afonso Dhlakama to sign a peace accord with President Armando Guebuza and run in an October 15 election (Reuters).
     
    EUROPE
    Ukraine Refuses Entry to Russian Convoy
    Ukraine said it will refuse entry (KyivPost) to a convoy of 280 Russian trucks carrying humanitarian aid to the east of the country, citing it as a violation of Ukraine's sovereignty and international law.
    In Ukraine, the United States seeks an outcome that may not be achievable, writes CFR President Richard N. Haass in this op-ed.
    SPAIN: Spain's interior ministry said that more than 1,200 migrants entered Spain illegally by sea over two days (BBC); as a response, Spain increased defenses at the borders of two territories in North Africa.

    Venezuela Closes Borders
    Venezuela's government instituted a nightly closure of all crossings along the 1,370-mile border to Colombia in a bid to prevent the flow of contraband fuels and foods to Colombia(LATimes). Venezuela loses roughly fourteen percent of its gasoline production in contraband sales, mostly to Colombia and Brazil.
    COLOMBIA: Colombia's military said it is deploying more troops to the eastern province of Arauca, a rebel stronghold, to counter a recent spate of attacks (BBC).

    Research from the Terrorism Research and Analysis Consortium (TRAC) indicates that the Islamic State returned the favour, actually sending fighters of Libyan origin – now trained and battle hardened – to assist Ansar al-Sharia in taking Benghazi. It was shortly after this decision was reached, on 22 July 2014, that the fighting in Benghazi intensified.
    ‘Ansar al-Sharia in Libya is an important ally for the Islamic State in expanding its presence and influence into Maghreb countries,’ said Jasmine Opperman, a TRAC director. ‘Such an alliance will allow the Islamic State to influence and direct the establishment of a smaller Islamic caliphate in Libya as a first step in expanding it into the Maghreb.’

    A unicidade do TCIC

    Fui dos que afirmei publicamente que o Tribunal Central de Instrução Criminal deveria voltar, no seu funcionamento interno, ao modelo com que já operara, o de um juiz para a prática dos actos jurisdicionais em sede de inquérito e um outro para a fase de instrução.
    O regime que vigorava nos últimos tempos era o de impor ao mesmo e único juiz o dever se avaliar da legalidade dos actos que ele próprio praticara em sede de inquérito - quando arguida a sua invalidade através da instrução - e tudo decidir sem recurso.
    Não estando em causa a probidade das pessoas, nem a fulanização da questão, sim uma questão de princípio, nunca me convenci de que este sistema fosse compatível com a Lei Fundamental apesar de o Tribunal Constitucional o ter viabilizado, pois nele cumulava-se na mesma entidade judicial a competência para o acto e para a sua sindicância, pondo em causa um pilar fundamental da estruturação do judiciário que é a terciarização face ao caso; isto para além das garantias defesa, que já quase se tornou argumento anémico na actual conjuntura jurídica. Isto para além de supor que a avaliação indiciária em sede de instrução pudesse ser outra quando imposta a respectiva apreciação a um magistrado que fora densificando a sua íntima convicção através dos actos que autorizara, a que presidira e que praticara, como o interrogatório de arguido detido, as intercepções de comunicações, as buscas.
    Mais: não compreendi que fosse exigível a um magistrado o esforço acrescido de distanciamento para que, desligando-se do envolvimento que tivesse tido no inquérito, conhecer com a isenção e independência a que está adstrito, o que dera como adquirido pelo seu prévio activo envolvimento com o caso. 
    Isto até porque o legislador, ao blindar e brindar com a irrecorribilidade a pronúncia obediente à acusação do Ministério Público, criava, em geral para todas as instruções e não apenas para as daquele Tribunal, uma questão de consciência pessoal: expor a decisão instrutória a recurso, distanciando-a do objecto configurado pelo Ministério Público ou conformá-la nos precisos termos em que este o delineara o caso, garantindo-lhe assim, através do conformismo, estabilidade e, sobretudo, intangibilidade.
    Apercebo-me que o problema pode ter perdido actualidade pela nomeação de outro magistrado para aquele tribunal. Resta saber se, em termos da competência funcional, se trata da mera repartição de processos, se de divisão de competência por fases.
    É que, ante o que leio - e confesso que leio pouco - parece-me que se está a centrar o problema em termos duplamente inaceitáveis: ou como o fim de um regime de suspeição sobre quem desempenhou funções ou como uma mera partilha da massa processual que por ali se tramita, oriunda do DCIAP que goza do benefício de ter aquele tribunal privativo, o que, só por si, é também uma outra questão; ou como uma mera questão de divisão do excesso de processos, como se de uma questão de gestão burocrática se tratasse.

    A situação do conflito Israel/Palestina poderia alterar-se se as partes vissem qualquer vantagem em fazer concessões mas não se imagina que isso possa acontecer proximamente. Israel não vendo qualquer espaço de entendimento com o Hamas não vai fazer concessões que comprometeriam o que tem conseguido ao longo do tempo para reduzir a vulnerabilidade da sua geografia. Essa vulnerabilidade, não lhe permite, no curto prazo, aceitar o levantamento do bloqueio à Faixa de Gaza sem o compromisso do Hamas em renunciar à violência e a aceitação da sua desmilitarização prévia.
    Do lado palestiniano, o grande obstáculo continua a girar à volta da recusa do Hamas em reconhecer o Estado de Israel. É preciso lembrar, em qualquer caso, que o problema central em cima da mesa é a criação do Estado Palestiniano e aí surge o problema do regresso de Israel às fronteiras de 1967 e a ocupação do West Bank, que o Governo israelita insiste em consolidar, não obstante a condenação internacional que essa postura tem gerado. Este assunto coloca Israel em confronto também com a Autoridade da Palestina.
